Terms and Conditions

1. Acceptance of These Terms

These Terms and Conditions ("Terms") govern your use of the Singing Lessons mobile application (the "App"), operated by Henry Reyes, based in the Dominican Republic ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the App.

2. Eligibility

You must be at least 13 years old to use the App. If you are under 18 (or the age of majority where you live), you may use the App only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the App, including any purchases.

3. License to Use the App

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, solely for your personal, non-commercial use.

You may not copy, modify, distribute, sell, rent, reverse engineer, decompile, or attempt to extract the source code of the App or its content, except as permitted by applicable law.

4. Subscriptions and Purchases

Some features and content of the App require a paid plan ("Premium"). We currently offer the following options, with prices shown in the App before purchase:

• Quarterly subscription: billed every three (3) months and renews automatically.
• Annual subscription: billed every twelve (12) months and renews automatically.
• Lifetime access: a one-time, non-recurring purchase that unlocks Premium for as long as we continue to operate and support the App.

Purchases are processed by Apple (App Store) or Google (Google Play), depending on where you downloaded the App, and are subject to their terms. Payment is charged to your Apple ID or Google Play account at confirmation of purchase.

Automatic renewal: Subscriptions renew automatically at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period.

Managing and canceling: You can manage or cancel your subscription at any time in your App Store or Google Play account settings. Deleting the App does not cancel a subscription. Cancellation takes effect at the end of the current billing period, and you keep access to Premium until then.

Free trials: If a free trial is offered, it converts to a paid subscription at the end of the trial unless canceled at least 24 hours before it ends. Any unused portion of a free trial is forfeited when you purchase a subscription.

Price changes: We may change subscription prices. Any change will be communicated in advance as required by Apple or Google and will apply to the next billing period.

Refunds: Because payments are processed by Apple or Google, refund requests must be submitted to them and are handled under their refund policies. We cannot issue refunds directly. Nothing in these Terms limits any refund rights you may have under applicable consumer protection law.

5. Vocal Analysis and Your Recordings

The App uses your device microphone to detect pitch in real time and offers a vocal analysis feature that lets you record or upload audio or video of your singing ("Recordings").

When you submit a Recording for vocal analysis, it is sent to a third-party artificial intelligence (AI) service provider to generate feedback. Recordings are used only to produce your analysis and are not stored on our servers. Our AI provider does not use them to train its models and may retain them for up to 30 days solely for abuse and safety monitoring before deleting them. We do not sell your Recordings. You retain ownership of your Recordings. You grant us and our service providers a limited, temporary license to process your Recordings solely to provide the vocal analysis to you.

You represent that you have the right to submit each Recording, and you agree not to submit recordings of other people without their consent or content that is unlawful, harmful, or infringes the rights of others.

AI-generated feedback is automated, may be inaccurate or incomplete, and is provided for general educational and entertainment purposes only.

6. Health and Safety Disclaimer

The App provides general singing instruction and vocal exercises for educational purposes only. It is NOT medical advice and is NOT a substitute for professional medical, vocal health, or speech-language care. We are not physicians, laryngologists (ENT doctors), or speech-language pathologists.

Singing and vocal exercises place physical demands on your voice. If you have a voice disorder, a medical condition, a recent illness or surgery, or any concern about your vocal health, consult a qualified healthcare professional before using the App.

Stop exercising immediately and seek professional advice if you experience pain, discomfort, persistent hoarseness, loss of voice, or any other unusual symptoms. You use the exercises at your own risk. Results vary from person to person and are not guaranteed.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms.
• Share, resell, or redistribute Premium content, or bypass any purchase or access controls.
• Interfere with, disrupt, or attempt to gain unauthorized access to the App, its servers, or related systems.
• Use bots, scrapers, or other automated means to access the App or its content.

8. Intellectual Property

The App and all of its content, including lessons, exercises, audio, video, text, graphics, logos, and software, are owned by us or our licensors and are protected by copyright, trademark, and other laws. Except for the limited license in these Terms, no rights are granted to you.

If you send us feedback or suggestions, we may use them freely without any obligation to you.

9. Third-Party Services

The App relies on third-party services, including Apple and Google for purchases, a subscription management provider, analytics providers, a push notification provider, and an AI service provider for vocal analysis. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services we do not control. 10. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT PITCH DETECTION OR AI FEEDBACK WILL BE ACCURATE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, OR ANY INJURY TO YOUR VOICE OR HEALTH, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY U.S. DOLLARS (US$50). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your Recordings, or your misuse of the App.

13. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App at any time. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law) will survive.

14. Changes to the App and These Terms

We may update, change, or discontinue features or content of the App at any time. We may also update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the App after changes take effect means you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws of the Dominican Republic, without regard to conflict-of-law principles. Before starting any legal proceeding, you agree to first contact us so we can try to resolve the dispute informally. Any dispute that cannot be resolved informally will be submitted to the competent courts of the Dominican Republic, and you consent to their jurisdiction.

Nothing in this section deprives you of the protection of mandatory consumer protection laws of the country where you live, or of any right you have under those laws to bring a claim in your local courts.

16. Additional Terms for Apple App Store Users

If you downloaded the App from the Apple App Store, you also agree that:

• These Terms are between you and us only, not Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and consumer protection claims.
• Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the App infringes intellectual property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
